Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you and Amos Haviv, trading as Daedally(“Podcust”, “we”, “us”) and govern your use of the Podcust website, mobile application, and related services (the “Service”). Daedally is registered with the Dutch Chamber of Commerce under KVK number 99844656. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

The Service is available only to individuals who are at least 18 years old and have the legal capacity to enter into a binding contract. By using the Service, you represent and warrant that you meet these requirements. Accounts may not be created or operated by anyone under 18. An adult account holder may select and play age-appropriate audio for a child, including through Focus Mode, but remains responsible for the account, the content selected, and the child’s use of it.

2. Accounts

You are responsible for the information you provide, for activity under your account, and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure.

3. Subscriptions, credits and payments

3.1 Credits

• The Service runs on credits. Generating an episode consumes credits at the rate shown at the time of the request. Credits have no cash value, are not a deposit or stored-value instrument, are non-transferable, and are not redeemable for money except where required by law.
• Credits may be granted as a promotional sign-up bonus, added by a subscription, or held over from an earlier purchase. Credits do not expire while your account is open, and we do not remove credits you have already received when a subscription ends.

3.2 Monthly subscriptions

• Podcust offers monthly subscription plans. Each plan has a credit level. Each paid month, your balance refills up to that level. Unused credits remain. If your balance is already above the level, no credits are added that month.
• A subscription also gives you unlimited playback of our curated playlists for as long as the subscription is active. One playlist per category and language stays free for everyone.
• Subscriptions renew automatically at the then-current price for the plan, once per month, until you cancel. You authorize us (or the app store you purchased through) to charge your payment method for each renewal.
• You may cancel at any time. Cancellation stops future renewals; it is not a refund of the current period. You keep your subscription benefits, including curated playback, until the end of the period you have already paid for, and you keep your credit balance afterwards.
• If a renewal payment fails, we may retry it and your access may be suspended or ended. Where the app store you purchased through offers a billing grace period, your access may continue for its duration.
• We may change subscription prices or credit levels prospectively. A change takes effect no earlier than your next renewal, and we will give you notice, and the chance to cancel, before it applies to you.

3.3 Where you bought it

• On the web, subscriptions are sold by us and processed by Stripe in U.S. dollars. Manage or cancel yours from the billing page in your account. Cancelling there stops the next renewal.
• In our iOS app, subscriptions are sold through Apple as auto-renewable App Store subscriptions, and Apple is the merchant of record. Prices are set per storefront and shown by the App Store before you buy. Manage, change tier, or cancel in your Apple ID subscription settings; we cannot cancel an App Store subscription for you. Apple's terms govern that transaction, including its billing and any grace period.
• A subscription bought in one place cannot be managed from the other, and you can hold only one Podcust subscription at a time.

3.4 Refunds

• For web purchases, subscription payments are non-refundable after a billing period begins, except where applicable consumer law requires otherwise. Credits already consumed to generate content cannot be restored unless required by law or the generation failed in a way for which the Service provides an automatic credit reversal.
• For App Store purchases, refunds are requested from and granted by Apple, not by us. If Apple refunds or revokes a purchase, we may remove the corresponding access.
• If you are an EEA consumer, you generally have a statutory right to withdraw from an initial web subscription purchase within 14 days of entering the contract. To exercise that right, email us at the address in section 14 before the period expires. If you ask us to begin providing the Service during that period, we may charge a proportionate amount for Service already supplied only where applicable law and the information provided at checkout permit it. Nothing in these Terms limits a refund, withdrawal, cancellation, or other remedy that cannot lawfully be limited.
• Taxes may apply and will be handled as indicated at checkout or by the app store.

3.5 Deleting your account

Deleting your Podcust account cancels a web subscription. It does not cancel an App Store subscription. You must cancel that in your Apple ID settings, or Apple will keep billing you. Credits are lost when the account is deleted.

4. Acceptable use

You agree not to use the Service to create, upload, or share content or to take any action that:

• is unlawful, infringing, defamatory, deceptive, fraudulent, hateful, harassing, or that violates the rights or privacy of others;
• impersonates any person or entity, or replicates the voice, likeness, or identity of a real person without their clear authorization and all necessary rights;
• is sexually explicit, exploits or endangers minors, or is intended for or directed to anyone under 18;
• contains malware, attempts to disrupt or gain unauthorized access to the Service, or scrapes or harvests data except as expressly permitted;
• generates spam, misinformation presented as fact, or content that violates any applicable law or third-party terms.

5. AI-generated content

Episodes are produced using automated AI systems. AI output can be inaccurate, incomplete, outdated, or fabricated, and may not reflect real events or real people. The Service does not provide professional, legal, medical, financial, or other advice. You are solely responsible for reviewing generated content before relying on it or sharing it publicly, and for ensuring it complies with these Terms and applicable law.

6. Your content and licenses

You retain ownership of the original inputs you submit. You represent that you have the rights necessary to submit those inputs and to authorize the resulting use. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, adapt, and display your inputs and the generated content as needed to operate, provide, secure, and improve the Service, including through the third-party processors described in our Privacy Policy. If you create an unlisted share link, we may display the episode and associated creator information to anyone who has that link. Unlisted links are not private. You can make the episode private or delete it to end access through the Service, but we cannot control copies that a recipient already made outside the Service.

7. Our intellectual property

The Service, including its software, design, and branding, is owned by Amos Haviv, trading as Daedally, or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except as expressly stated.

8. Moderation and termination

We may review, remove, or restrict content and may suspend or terminate access at our discretion, including for violations of these Terms or to comply with law. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination will survive.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. This does not exclude warranties or rights that cannot be excluded under applicable law.

10. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so is unlawful, including liability for fraud, intentional misconduct, gross negligence, or death or personal injury caused by negligence. Otherwise, to the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid to us in the 12 months before the event giving rise to the claim or EUR 100. Mandatory consumer rights are not affected.

11. Indemnification

You agree to indemnify and hold harmless Amos Haviv, trading as Daedally, from claims and expenses arising out of your content, your use of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

12. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. Disputes will be submitted to the competent courts in Amsterdam, Netherlands, except where mandatory law gives you the right to bring proceedings elsewhere. Mandatory consumer-protection rights in your country of residence are not overridden by this section.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a revised “Last updated” date and, where required, provide additional notice. Continued use after changes take effect constitutes acceptance.
