This Privacy Policy explains how Amos Haviv, trading as Daedally (“Podcust”, “we”, “us”) collects, uses, shares, and protects personal data when you use the Podcust website, mobile application, and related services (the “Service”). Amos Haviv is the data controller, registered with the Dutch Chamber of Commerce under KVK number 99844656, at Tuinstraat 23, 1015 NX Amsterdam, Netherlands.

1. Age requirement

The Service is intended only for adults aged 18 or older. It is not directed to children, and we do not knowingly collect personal data from anyone under 18. If you are under 18, do not use the Service or provide any information to us. If we learn that we have collected personal data from a person under 18, we will delete that data and close the account. Adults may select audio for children and let them listen under adult supervision, including through Focus Mode. Children must not create or operate accounts. To generate episodes, the topics and prompts you submit are sent to third-party artificial-intelligence providers: Google (Gemini models) for research and script generation, and ElevenLabs for text-to-speech audio, with OpenAI as a fallback text-to-speech provider. These providers process your inputs on our behalf to return generated content. Do not submit sensitive personal data or confidential information in episode topics or prompts.

Where the GDPR applies, we rely on the following legal bases: performance of our contract with you (to provide the Service and process payments); your consent (for analytics and non-essential cookies, and optional marketing communications); our legitimate interests (to secure, maintain, and improve the Service and prevent abuse), balanced against your rights; and compliance with legal obligations.

We do not sell your personal data. We share data with service providers that process it on our behalf under contract, including:

We may also disclose data where required by law, to enforce our terms, to protect rights and safety, or in connection with a corporate transaction such as a merger or acquisition. Episodes shared through an unlisted link, together with the creator name and profile image shown on that page, are visible to anyone who has the link. Recipients can share that link outside the Service.

We and our service providers may process data in the Netherlands, other EEA countries, the United States, and other countries in which they operate. Where required for a transfer outside the EEA or UK, we use the lawful mechanism applicable to the provider and transfer, such as an adequacy decision, the EU-US Data Privacy Framework where available, the European Commission’s Standard Contractual Clauses, or the UK Addendum or International Data Transfer Agreement. 8. Data retention

Account data, private content, and unlisted content are kept while your account is active and deleted or anonymized from active systems after you delete the account, subject to backup rotation, legal holds, and the exceptions below. Payment, transaction, and core accounting records are retained for at least seven years where required by Dutch tax law. Security, support, and diagnostic records are retained for the period needed to investigate the issue, protect the Service, or establish and defend legal claims, then deleted or anonymized. Push tokens are kept until they are replaced, invalidated, or the related account is deleted. Analytics data is kept for the shortest retention period configured in the relevant analytics service that supports our measurement needs. Consent preferences stored in your browser expire after 12 months.

9. Your rights

Subject to applicable law, you may have the right to access, correct, delete, export, restrict, or object to the processing of your personal data, and to withdraw consent at any time without affecting prior processing. EU and UK users have the right to lodge a complaint with their local data protection supervisory authority. To exercise any right, contact mail@podcust.com. We will respond within the timeframes required by applicable law.

10. Security

We use technical and organizational measures designed to protect personal data, including hashing of account passwords and encrypted transport. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version with a revised “Last updated” date and, where required, provide additional notice.
